Police say the disagreements between the neighbours has been an ongoing issue, alleging they have been called to the address more than once to speak with the accused.
Mr Gillett received a seven-month suspended sentence and will serve the remainder of the term on a good behaviour bond.
The incident in question allegedly started on August 15 at 5.20am last year. A witness was walking to his car to go to work when he saw a car parked in the accused’s front yard, pointed at the victim’s house with high beams on.
He witnessed Mr Gillett get in and out of the car, reverse twice before moving back into the original position.
Later that same afternoon, the defendant was allegedly doing burnouts in his front yard in a white station wagon. The victim began recording his defendant on his phone, walking to the front of his house.
Other court stories:
Mr Gillett then got out of the car to face the victim. He allegedly indicated his actions were “all because” of a CCTV camera on the victim’s house.
After a short disagreement over whether the incident should be recorded, police say the defendant approached their shared fence and daring the victim to jump it.
The victim then approached the fence and stood opposite the Mr Gillett. The defendant then swung a clenched fist at his neighbour’s head, missing it when the victim moved back.
The same witness from earlier that morning walked down the road to see what all the commotion was about, coming up behind the Mr Gillett.
He tried to swing one final punch, the victim again moved back and the witness attempted to intervene. Following a short conversation with the witness, Mr Gillett went inside.
Police arrived at the defendant’s home at 3:40pm that afternoon. The defendant was taken to Leeton Police station and later charged.
