Csaba Somogyi did not appear in Tamworth Local Court when his case was called but magistrate Julie Soars was told he had obtained a new defence lawyer.

Somogyi is accused of dangerous driving occasioning death by driving in a manner dangerous, as well as negligent driving occasioning death.

The charges stem from a crash during the Riverina Redneck Rally near Manilla on March 5 this year where a man, who was a passenger, died at the scene.

"The brief is EAGP compliant," Police Prosecutor Sergeant John Brissett told the court, adding it met all the requirements.

The case has now been referred to the Director of Public Prosecutions (DPP) to consider if it will take charge of the case.

Somogyi or his solicitor didn't appear in court, but when contacted by the magistrate, the former solicitor said they were no longer instructed in the case.

"He has a new solicitor acting for him," the solicitor told the court via phone, before the new lawyer's details were found.

Ms Soars granted the adjournment for charge certification for the DPP to consider the brief of evidence and finalise the charges it intends to prosecute.

The case was adjourned to September. He has not been required to enter pleas to the charges yet. He remains on conditional bail.

Ms Soars told Somogyi's new solicitor his client would have to appear via video link on the next occasion.

The court heard the accused lives in southern NSW.

Somogyi was behind the wheel of a Volkswagon Golf in the deadly crash on March 5 on Banoon Road at Banoon, near Borah Creek, just out of Manilla.

Police allege he lost control of the hatchback just after 1pm, and rolled several times before crashing into a tree.

Somogyi was treated for multiple injuries, while his passenger, a 49-year-old man, died at the scene, about 80km from Tamworth.

The pair were competing in the Riverina Redneck Rally, which had left West Wyalong on its first day, and were en route from Warialda to Nundle on the day in question.
